Is possible use OpenStreetMap in commercial product. We think to show different popups when hovering over the MAP alternatively show the data in separate Window. Is this possible with out making our code Open Source. The data is not geographical data for example it could be a pie charts of different types of coffee that has been sold at a coffee shop at the current location of the MAP.

It is fully possible to use OpenStreetMap in a commercial product. The only thing we require is that you credit OpenStreetMap. However we would prefer donations and that you help making the map better.

We require that any derrivative data to be open. However your data does not seem to be derrivative. It seems as your data have been produced without the help of any OSM data. This does not have to be released under a free licence.

Depending on your usage you might also need to consider the various acceptable use policies, linked from http://wiki.openstreetmap.org/wiki/Acceptable_Use_Policy - if you are using OSM tiles for the background then the Tile Usage Policy is perhaps most relevant. If you were to download a data extract and generate your own tiles then these policies wouldn't be an issue.
